Terms of Service for MigraineMap+

1. Acceptance of Terms

By downloading, installing, or using the MigraineMap+ mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

MigraineMap+ is a personal health tracking application that allows users to log headaches and migraines, detect patterns and triggers, and generate reports for healthcare providers.

3. Eligibility

• You must be at least 13 years old to use MigraineMap+
• If you are between 13 and 18, you should have parental or guardian consent
• You are responsible for maintaining the security of your device and the data stored on it

4. Acceptable Use Policy

You AGREE to:

• Use MigraineMap+ for personal health tracking purposes
• Provide accurate information in your headache logs
• Keep your device and app data secure
• Comply with all applicable laws

You AGREE NOT to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to hack, disrupt, or damage the App
• Use the App for any illegal activities
• Redistribute or resell the App or any part of it

5. User Data and Content

• You retain full ownership of all data you enter into MigraineMap+
• Your data is stored locally on your device — we do not have access to it
• You are responsible for backing up your data before uninstalling the App
• Deleting the App will permanently remove all locally stored data

6. In-App Purchases and Subscriptions

Premium Features

• MigraineMap+ offers optional premium features available through in-app purchases
• Subscription options include monthly, annual, and lifetime plans
• All purchases are processed through the Apple App Store

Billing and Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings

Refunds

• Refund requests are handled by Apple per their App Store refund policy
• We cannot process refunds directly

7. Apple HealthKit Integration

• HealthKit integration is optional and requires your explicit permission
• Data read from HealthKit is used only for headache correlation and is never transmitted off your device
• We comply with Apple's HealthKit guidelines — HealthKit data is never used for advertising or shared with third parties
• You can revoke HealthKit access at any time in iOS Settings

8. Intellectual Property

MigraineMap+ and its content, features, and functionality are owned by us. The MigraineMap+ name, logo, and design are protected intellectual property. You may not copy, modify, or distribute the App or its content without our written permission.

9. Limitations of Liability

No Warranty: MigraineMap+ is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.

Health Disclaimer: We make no guarantees about the accuracy of pattern detection, trigger analysis, or any health-related insights provided by the App.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to:

• Loss of data due to device failure or app deletion
• Reliance on pattern detection or trigger analysis for medical decisions
• Interruption or unavailability of the App

10. Privacy

Your use of MigraineMap+ is subject to our Privacy Policy, which describes how we handle your information.

11. Termination

You may stop using MigraineMap+ at any time by deleting the App. We reserve the right to terminate or suspend access to premium features if you violate these Terms.

12. Modifications

We may update these Terms periodically. Continued use of MigraineMap+ after changes constitutes acceptance of the updated Terms. We will update the "Last Updated" date when changes are made.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
